Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Hello Native AI platform, websites, dashboard, APIs, voice agent (ALMA), and related services (collectively, the “Service”) operated by Hello Native AI (“Hello Native,” “we,” “us,” or “our”). By creating an account, accessing a workspace, integrating with our APIs, or otherwise using the Service, you agree to these Terms. If you accept on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
Hello Native is an AI-native website and operations platform for hospitality, real estate, and construction operators. The Service includes: hosted tenant websites, a multi-tenant dashboard, an inline editor, AI content generation, ALMA voice agent across phone/web/SMS/WhatsApp, and integrations with third-party services including but not limited to Google Workspace, Google Marketing Platform, Twilio, Stripe, Channex, and CallRail. Feature availability and limits depend on your plan and may evolve over time.
2. Eligibility and account
You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date. You are responsible for all activity that occurs under your credentials, including activity by team members you invite. Notify us at info@hellonative.ai immediately if you suspect unauthorized access.
3. Subscription, billing, and term
Plans are billed monthly or annually as selected at checkout. Fees are payable in advance and are non-refundable except where required by law. Hello Native may change pricing on 30 days notice for the next billing cycle. Failure to pay may result in suspension or termination of access. Taxes (sales, VAT, and similar) are added where required by law.
Your subscription continues for the term selected and renews automatically for like terms unless canceled at least 24 hours before renewal. Cancellations take effect at the end of the current paid period; downgrades take effect at the next renewal.
4. Customer data and ownership
You retain all right, title, and interest in the content, listings, customer information, integration credentials, and any other data you submit, transmit, or display through the Service (“Customer Data”). You grant Hello Native a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create derivative works of Customer Data solely to provide and improve the Service for you, and to comply with legal obligations.
You represent and warrant that you have the rights necessary to grant this license, that Customer Data does not infringe any third-party rights, and that its collection and use complies with applicable law (including data-protection laws). On termination of your account you may export Customer Data; we delete it after a 30-day grace period (longer where required by law).
5. Acceptable use
You may not use the Service to:
- Violate any law, infringe any third-party right, or process personal data without a valid legal basis.
- Send unsolicited commercial messages (spam) or operate any feature in a way that violates anti-spam, telemarketing, or messaging laws (CAN-SPAM, TCPA, GDPR e-Privacy, CASL, and equivalents).
- Send or store malicious code, attempt to circumvent security controls, scrape protected resources, or perform load testing without prior written consent.
- Resell, white-label, or sublicense the Service except under an explicit reseller agreement with Hello Native.
- Use ALMA voice features to record, store, or transmit calls in ways that violate two-party-consent recording laws applicable to the call participants.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the integrity or performance of the Service or the data it contains.
Hello Native may suspend or terminate access for violation of this section without liability and with notice as soon as practicable.
6. Third-party integrations and Google services
The Service integrates with third-party providers, including (without limitation) Google (Workspace and Marketing Platform), Twilio, Stripe, Channex, Anthropic, OpenAI, Cartesia, Deepgram, Vercel, Neon, and Cloudflare. Your use of those services through the Service is governed by their respective terms. You are responsible for reviewing and accepting them.
When you connect a Google account to Hello Native, you authorize Hello Native to access the Google APIs you grant scopes for, on your behalf, in accordance with the Google API Services User Data Policy including its Limited Use requirements. Our specific handling of Google data is described in our Privacy Policy. You may revoke this access at any time at myaccount.google.com/permissions or from the integrations panel inside your Hello Native dashboard.
7. Intellectual property
Hello Native and its licensors own all right, title, and interest in the Service, including the code, design, trademarks, and documentation, except for Customer Data. The Service is licensed, not sold. Hello Native grants you a non-exclusive, non-transferable, worldwide license to access and use the Service during your subscription term, subject to these Terms.
The tenant website code generated for you on Hello Native is real Next.js code; you may export and redeploy that code on your own infrastructure, retaining the license terms of any third-party packages used.
Hello Native may use anonymized, aggregated metrics derived from Service usage (without Customer Data attribution) to improve the platform.
8. AI-generated output
The Service uses third-party AI models (Anthropic, OpenAI, Google, and others) to generate content, voice, and recommendations. AI output may be inaccurate, incomplete, or unsuitable for your specific context. You are responsible for reviewing AI output before publication or external use, and for ensuring it complies with applicable law and your professional duties (including but not limited to real-estate disclosure rules, hospitality marketing standards, and contractor licensing requirements). Hello Native makes no warranty regarding AI-generated content.
9. Privacy
Our handling of personal data is governed by the Privacy Policy. By using the Service you agree to the practices described there.
10. Confidentiality
Each party may disclose confidential information solely to perform its obligations under these Terms. Confidential information must be protected with the same care the receiving party uses for its own confidential information (and in no case less than reasonable care). This section does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
11. Service levels and modifications
Hello Native targets high availability but does not guarantee uninterrupted access. We may schedule maintenance windows, modify features, or deprecate components with reasonable notice. Material changes that reduce functionality you actively use will be announced in advance via email or the dashboard.
12. Termination
You may cancel your subscription at any time from the dashboard or by contacting support. We may suspend or terminate access for material breach (including non-payment after notice), unlawful use, or risk to the platform or other customers, with notice where reasonably practicable. On termination, your access ceases and Customer Data is retained for the export period described in §4.
13. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions the disclaimer applies to the maximum extent permitted.
14. Limitation of liability
To the maximum extent permitted by law, Hello Native’s aggregate liability arising out of or related to the Service in any 12-month period will not exceed the fees you paid for the Service in that period. Hello Native is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost goodwill, or business interruption, even if advised of the possibility. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted.
15. Indemnification
You agree to defend, indemnify, and hold harmless Hello Native and its affiliates, officers, employees, and agents from any claim, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your Customer Data, your use of the Service, your breach of these Terms, or your violation of any third-party right or applicable law.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. Nothing in this section limits either party’s right to seek injunctive relief in any court of competent jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business. Material changes will be communicated by email or a dashboard notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
18. Miscellaneous
These Terms are the entire agreement between you and Hello Native regarding the Service and supersede prior agreements. Failure to enforce any provision is not a waiver. If any provision is held unenforceable, the remainder will continue in full force. You may not assign these Terms without our written consent; we may assign in connection with a merger, acquisition, or sale of assets. Notices to you may be delivered to your account email; notices to us must be sent to info@hellonative.ai.
